YRCW will issue a reverse stock split after April 24, 2010 not prior too, they are not in compliance with the $1.00 rule and will be delisted if there share price does not maintain the $1.00 closing bid price for 10 consecutive days, they were notified on March 5, 2010, they have 30 days to comply, this is getting interesting, so will it go, or will it fail, that is the question.

any takers?

any opinions?

Sen. Bob Casey of Pennsylvania said he would introduce a bill intended to protect the pension payments of retirees of failed businesses while assisting companies such as YRC, whose pension liabilities include non-YRC retirees.

Multi-employer pension plans such as the Teamsters’ Central States Pension Fund have become severely underfunded in recent years as more unionized companies have liquidated. That has left fewer employers to pay into the funds, which continue to provide benefits to the retirees of the failed companies.

YRC is the biggest contributor to the Central States plan, which has more than 430,000 participants and 2,000 employers. YRC and other big companies such as Kroger and Associated Wholesale Grocers also participate in other union-run, multi-employer pension funds.

As part of its reorganizing to remain viable, YRC received Teamsters approval last year to suspend monthly payments into the union pension plans until next January. Before the suspension, YRC had been paying about $40 million monthly into those funds. About 40 percent of YRC’s pension costs have gone to fund the pensions of the so-called orphans, retirees who work for failed companies and were never employed by YRC.

Casey said the Senate legislation would address the problem in a couple of ways.

First, it would allow multi-employer pension funds to merge as a way to reduce costs.

Second, after satisfying certain requirements, the multi-employer plan would be able to create a separate account to transfer assets and liabilities for the projected benefit payments to the orphans for five years.

The Pension Benefit Guaranty Corp., the federal agency that provides pension payments to employees of failed companies, would monitor the separate accounts. After five years, the federal agency would take over benefits paid to the orphans.

A similar bill has been introduced in the U.S. House of Representatives.

Casey’s news conference Monday was held at a YRC regional carrier’s operation in Carlisle, Pa.

Since deregulation of the trucking industry in the 1980s, hundreds of carriers have shut down, leaving fewer unionized truckers to fund the pension plans, said Mike Smid, president of YRC Inc., the company’s national carrier.

“A penalty has been placed on the unionized companies that remain,” said Smid, who also is chief operations officer of YRC Worldwide. “It’s unfair and unsustainable.”

The Teamsters union supports Casey’s bill, as well as the similar bill in the House. An executive from Kroger attended Casey’s news conference in support of the bill.

Casey, a Democrat, said the federal government’s cost for the pension assistance would be $8 billion to $10 billion
